Terms of Service

Please read these terms before using CrunchByte.

1. Acceptance of Terms

By purchasing a plan or using any service offered by CrunchByte, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. We may update these terms from time to time, and continued use of our services after changes are posted means you accept the updated terms.

2. What We Provide

CrunchByte offers Discord bot hosting and pre-built Discord bot services. Our services include:

CrunchByte operates in accordance with Discord's Developer Terms of Service and Developer Policy. We do not guarantee compatibility with bots that use unsupported runtimes, are built on non-standard frameworks, or violate Discord's own Terms of Service.

3. Account Structure and Sub-User Access

The CrunchByte control panel operates on a one account per bot server basis. Each hosted bot or service is tied to a single registered account holder.

The Pterodactyl panel supports sub-user access, which allows you to grant other individuals access to your server directly through the panel without involving CrunchByte. This is managed entirely by you. We are not notified of, involved in, or responsible for any sub-user accounts you create or remove.

Liability waiver for sub-user access: By granting any individual access to your server through the panel, you accept full responsibility for all actions taken under your account, regardless of who performed them. CrunchByte assumes no liability whatsoever for any damage, data loss, bot downtime, misconfiguration, deletion of files, misuse of resources, or any other harm that results from access granted to a third party. This includes situations where a trusted party acts negligently, maliciously, or beyond the scope of what you intended. All promises related to account security, data integrity, and service continuity apply only to the registered account holder.

4. Acceptable Use

You are responsible for ensuring your bot complies with Discord's Terms of Service, Developer Terms of Service, and Community Guidelines at all times. CrunchByte will not host or continue hosting any bot that puts our platform or other users at risk of a Discord policy violation.

You agree not to use CrunchByte's services to host or operate bots that:

We reserve the right to suspend or terminate your service immediately and without refund if we determine your bot violates these rules.

5. Payment and Billing

All prices are listed in CAD. Payments are processed through our checkout page via PayPal or card. Monthly and yearly plans are billed on a recurring basis. Lifetime plans are a single one-time payment. You are responsible for ensuring your payment details remain valid. Failed or lapsed payments may result in your bot being taken offline until the issue is resolved.

Yearly subscriptions are billed upfront for the full year at a discounted rate. Lifetime purchases grant access for as long as CrunchByte operates as a service.

6. Refunds

CrunchByte does not offer refunds. All sales are final. Please review the plan details carefully before purchasing. If you have questions about whether a plan is right for you, reach out before buying and we are happy to help.

7. Service Availability

We aim to keep your bot running 24/7. However, we do not guarantee uninterrupted service. Downtime may occur due to power outages, scheduled maintenance, hardware issues, or circumstances outside our control. Power outages are credited at $0.50 CAD per hour of downtime off your next bill. 8. Termination

You may cancel your subscription at any time by contacting us. Cancellations take effect at the end of your current billing period. CrunchByte reserves the right to terminate any account at any time for violations of these terms, with or without notice. In the event we shut down the service entirely, we will provide reasonable advance notice where possible.

9. Limitation of Liability

CrunchByte is a small independent service. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services, including data loss, bot downtime, or missed opportunities. Our total liability in any case is limited to the amount you paid us in the 30 days prior to the event giving rise to the claim.

This limitation applies with full force to accounts where credentials have been shared with third parties. As outlined in Section 3, sharing account access constitutes a waiver of account protection guarantees, and CrunchByte bears no liability for any outcome arising from that shared access.

10. Intellectual Property

You retain full ownership of your bot's code. By uploading your bot to our servers, you grant CrunchByte permission to host and execute it solely for the purpose of delivering the service. We do not claim any rights to your bot or its code.

Pre-built bots (such as the Ticket Bot) are owned by CrunchByte. Your subscription or lifetime purchase grants you the right to use the bot in your server, not to copy, resell, or redistribute the underlying code.

11. Governing Law

These terms are governed by the laws of Canada and the United States. Any disputes arising from these terms or your use of CrunchByte services will be handled in accordance with Canadian law.
